IG for Interior: Abandoned mines pose an "ominous" threat to public health and safety

Scattered all over the western United States are more than 12,200 abandoned mines on Bureau of Land Management (BLM) and National Parks Service (NPS) lands, many of which pose significant dangers and public health risks. A recent audit (.pdf) by the Inspector General for the Department of the Interior finds that not only are many of the sites a danger to the public health and safety, but apparently, because they were worried about liability and cost, supervisors told staff members to ignore these problems and that employees "were criticized or received threats of retaliation" for identifying contaminated sites.

To prepare the audit, the Inspector General's staff visited more than 45 abandoned mines. The report highlights two distinct dangers to the public - dangerous levels of contaminants such as arsenic, lead and mercury are present at sites easily accessible to the public; and immediate threats to public safety posed by frequently unmarked open mine shafts and crumbling yet unsecured, access points (see above). "The potential for more deaths or injuries is ominous," the report states. The office said a "limited search" of accident records showed that 12 people were killed at abandoned mines from 2004 to 2007. Go back five more years to 1999 and the number of fatalities rises to 33.




The IG's team found that many of the open shafts weren't even marked. Placement of signs such as this, that could warn unsuspecting hikers, ATV riders and off-road mororists that a mine shaft is in the area and there is the possibility of death or injury.

Population growth and the use of off-road vehicles in the Western states are likely to increase the incidence of additional deaths or injuries.

In addition to mines, other abandoned facilities, like the dilapidated mill pictures on the right, also represent significant dangers.









Open shafts, crumbling adits and abandoned mills pose an immediate threat to those who pursue outdoor recreation; heavy metals contamination by arsenic, mercury and lead pose a significant environmental and public health threat.

At the 90-acre Caselton Tailings site in southeast Nevada, easily accessible from Hwy 320, the auditors found about three million cubic yards of mine tailings, or mine waste, from an abandoned mill nearby. Those tailings, stored underwater in nine ponds scattered about the site, contain dangerously high levels of heavy metals.

The water in those containment ponds is heavily acidic and contaminated and poses a significant threat to humans and wildlife alike if they consume it, and it is acidic enough to cause serious acid burns to human skin on contact. When the inspectors visited the site, they observed ATV tracks across tailings that are not underwater. The tailings are not marked as hazardous, so outdoor enthusiasts cross them on foot or by vehicle, and inhale the dangerous, contaminated dust.

Caselton Wash, toward Meadow Valley Wash, and within three miles of the town of Panaca, and local water wells. An engineering study conducted on the site determined that a catastrophic release of mine waste could "severely and significantly" threaten water quality for the population living nearby.

BLM claims that the site poses no threat to groundwater - but has never done a test of the groundwater to obtain baselines or determine if contamination might already have occurred.

Over the last decade or so, the BLM has been in (so far unsuccessful) negotiations with two entities that are interested in reprocessing the waste products. Reprocessing would reduce the environmental contamination, and could lead to additional resources and further mitigation efforts.

BLM insists that the decision to keep negotiating while the contamination gets closer and closer to the water supply is justified, and in the best interest of the government and the public. Seriously.

While the BLM has control of the majority of the abandoned mine sites on Department of Interior lands, the audit found that it has no effective program to address them. The abandoned mines program has been undermined, neglected and marginalized by poor management practices, insufficient staffing and inadequate resources.

The audit found that the National Park Service (NPS) has been far more successful in mediating the problem of abandoned mines - but the NPS has control of far fewer abandoned sites than does the BLM. Still, the NPS has hundreds, if not thousands, of sites that need to be mediated. At one park, the abandoned mine inventory includes over 600 sites, and NPS officials have inspected less than half of the sites on the 1.4 million acres comprising the park. While NPS has a more effective program, current funding for NPS' abandoned mines program is inadequate to address these hazards, and NPS has failed to develop a credible estimate of the total cost of mitigation.

The audit suggested that the BLM and NPS would be more successful working together to solve the problems than they can be independently. Working together would present opportunities to share resources, expertise, and best practices to improve their programs.

Certainly the expense of cleaning up abandoned mine sites is a legitimate concern, estimated to run into the billions, there are some relatively simple steps that can be taken to decrease the danger at some of the most dangerous sites. Posting signs and building fences where open mine shafts and adits are examples of relatively easy fixes for those threats to physical safety. At environmentally contaminated sites, staff couod reduce air and water-borne contamination by controling dust with sprinklers and temporary covers.

Overall, the cleanup solution is far from simple. It calls for a complex and concerted effort, including the immediate mitigation of known hazardous sites. A calculated effort to identify and inventory unknown sites is also needed, as is a methodological design to address abandoned mines in a comprehensive manner. Securing the necessary funding will be difficult.

The findings of the audit illustrate the urgency of the situation, and ought to trigger a call to action by both the Interior Department and Congress, the audit provided recommendations designed to help develop comprehensive solutions to the myriad problems that, while not of DOI's making, now most certainly fall under their sphere of responsibility.

But the most disturbing finding of the audit remains the fact that they found credible the claims that BLM supervisors told staffers to ignore the problems, and that employees were threatened with retaliation for identifying contaminated sites. One employee stated that adding sites to an inventory list and declaring them unsafe was more detrimental to BLM because doing so acknowledged a hazard and a potential liability.

Better Democrats, Please

Can we get some real Democrats?

Or at least some who know how this game is played?

You see, we are a nation founded on Liberty, but some among us have a pretty screwed up idea of what constitutes Liberty. Unfortunately the poltroons in need of a refresher course are our elected representation.

If they will not hold this administration accountable, they do not represent me.

If they will not make the obstructionist pricks in the GOP actually fillibuster a bill, they do not represent me.

If they think they can govern from the center, they do not represent me.

If they will not uphold the Fourth Amendment, they do not represent me.

If they will not uphold the First Amendment, they do not represent me.

If they will not restore Posse Comitatus, they do not represent me.

If they will not restore the Insurrection Acts of 1807, they do not represent me.

If they will not restore Habeas Corpus, they do not represent me.

If they will not revoke torture as official policy of this administration, they do not represent me.

If they will not vote for common-sense troop protections like the Webb Amendment, they do not represent me.

If they compromise on any part of the Constitution, they do not represent me.

If they do not stand up to the Deserter in Chief, they do not represent me.

If they do not take concrete steps to end the occupation of Iraq, they do not represent me.

If they get on board with a decades-long occupation of Iraq, they do not represent me.

If they do not represent me, I will support primary challengers.

I was pissed off at the MoveOn ad, too - but not because it offended me. I was pissed off about it because I knew the frothing fuckwits would get worked up into a lather and draw fortification from it, at just a time when the public was getting there on their own.

But once it was out there, it was the job of the Democrats to defend the First Amendment, and ask pointedly "where was the criticism when Kerry was swift-boated and when Cleland was smeared?

Instead, they lined up to take turns shredding the first amendment. Here is the thing about the First Amendment - it guarantees FREE speech - it does not guarantee that speech will be tasteful, or that no ones feelings will get hurt. It just means that it is FREE.

It means that I can tell Claire McCaskill that she is a disappointment and a disgrace and I am seriously starting to resent all the time that I spent on her campaign.

Fat lot of good it did me, for the way her votes have fallen.

Every single Democrat who has fallen in line needs a primary challenger. The rot in Washington is to the core in both parties. Democrats who won't stand up now need a primary challenge. If you are a Representative who wants to abdicate your responsibility to impeach this criminal administration, you need a primary challenger. If you are a senator who can not defend the Constitution, you need a primary challenger. If you are a Democrat who does not protest the long-term occupation of Iraq, you need a primary challenger.

The answer here is not to fall into an abject funk - it is to get pissed, and stay pissed, all the way from today through the first Tuesday in November 2008.

And I just did something I have never done before. I made a donation to MoveOn. Not only that, throughout the rest of the month, I am donating half of every donation that comes in to this blog to MoveOn, just because it will agitate the fuck out of the squawking chickenhawks on the right. I want yellow feathers to fill the air. I will not be happy if less than three foam-flecked fuckwits fall over twitching, having stroked out at the audacity of us dirty fucking hippies.

In closing, I want to remind every Democratic politician that elections have consequences - and so do their votes. They need to keep in the front of their mind that a failure to act upon the consequences we hit the Republicans over the head with in 2006 will lead to more consequences. It's called a stiff primary challenger with netroots fundraising support, bitches.

My Senator attempts to explain herself after selling out the Fourth Amendment

I sure have been getting some quintessentially pathetic, lame-assed correspondence from my elected representatives lately. The kind of drivel that makes people think Democrats don't have the intestinal fortitude for knock-down, drag-out, bare-knuckle politics.

First, Emmanuel Cleaver tried to sell me on the notion that "history would impeach" this administration. I was absolutely stunned that he would piss on my leg like that and try to tell me it was raining.

But then, today, Claire McCaskill broke my heart.

I emailed her office expressing my disappointment with her roll-over vote on FISA, in her haste to get her vacation started the day she stabbed me in the back.

Here is her response to my concerns.

Dear [Blue Girl]:

Thank you for contacting me regarding the Protect America Act of 2007 (S. 1927). I appreciate hearing from you, and I welcome the chance to respond.

On August 1, 2007, I was faced with a stark reality: the Director of National Intelligence sent a letter warning the Senate of the heightened threat of international terrorism, and urging us to modernize the Foreign Intelligence Surveillance Act (FISA) before the August recess "to ensure that we do not have critical gaps in our ability to provide warnings of threats to the country". The call to quickly revise FISA in order to reflect developments in telecommunications technology was echoed by four Democratic members of the Senate Intelligence Committee. I chose to heed these urgent warnings. [It did not occur to you that you might be getting played? Seriously? You were a prosecutor! Your bluff was called that easily? Not inspiring my confidence here.]

I voted for two measures to amend the Foreign Intelligence Surveillance Act. I preferred the legislation offered by Senators Rockefeller and Levin; however, it failed to gather the 60 votes needed to pass. I also voted for the Bond-McConnell version, which did receive enough votes to pass. Corresponding legislation was later approved by the House of Representatives, and the President quickly signed the bill into law. [I follow this stuff, too. You should have voted "No" on Bond's bill, too. You sold me out, and you betrayed the Fourth Amendment to the Constitution. Ah well, it had a 220 year run. It could have been longer. It should have been longer. But our representation in D.C. is feckless, faithless, and fearful. I am utterly disgusted and appalled by the lack of will I detect on behalf of my congressional delegation. Not one more dime for you, and I have decided that in 2012, you need a primary challenge. I absolutely can not wait until I get a request for cash or shoeleather. i have my rap ready.]

It is important to recognize that this legislation is a temporary fix to provide our intelligence community with the most immediate tools needed to protect our country – it will be in place for only six months, and it cannot be renewed before it is thoroughly reviewed and authorized by Congress. This gives us six months to create a more acceptable permanent intelligence collection process that that allows us to effectively monitor terrorist communications overseas while also protecting the privacy of law-abiding American citizens. I can assure you I will be one of the Senators working hard to re-establish the constitutional protections that have been eroded by this President and this temporary FISA legislation. [I call bullshit. This is NOT just a six-month fix. I read the text. It stays in effect a full 12 months after the sunset. Lie to a gullible sap, if you must. But don't fucking lie to me, I will call your ass on it. Every. Fucking. Time. Telling me you will do the job I busted my ass to elect you to next time ain't good enough. Do the fucking job I got you elected to right the first god-damned time! That I even have to say this disgusts me.]

Again, thank you for taking the time to share your concerns with me. Please do not hesitate to contact me if I can be of any further assistance. Ted Nuisance: Not just insane, but a pathetic, pissing coward, too!

By now you have all seen the YouTube of Ted Nuisance strutting across the stage brandishing a machine gun and telling Hillary and Obama to "suck on this" and he calls Obama a "piece of shit" and a "punk."

Ted maybe ought to exercise a little care when throwing around terms like "punk" - especially when the public record shows him to be a draft-dodging punk of the first order. When it was his time to step up and wield a machine gun for real, he pussed out, big time.

Stabbed in the back by sixteen sniveling surrender-monkeys

I hang my head in shame. I am so fucking furious with Claire McCaskill right now…At this moment in time, I can not denounce her with enough venom, and I vow I will never support another McCaskill candidacy for anything. That vote was an unforgivable sin. You see, I worked my ass off for her election. My number one gripe (and I had a laundry list) with Jim Talent was his habit of giving Bush carte blanche 97% of the time, especially where my civil liberties were concerned.


Last night, Claire lived down to the expectations I had for Talent when he held Harry Truman’s old Senate seat.


She was joined by fellow spineless cowards Evan Bayh (Indiana); Tom Carper (Delaware); Bob Casey (Pennsylvania); Kent Conrad (North Dakota); Dianne Feinstein (California); Daniel Inouye (Hawai‘i); Amy Klobuchar (Minnesota); Mary Landrieu (Louisiana); Blanche Lincoln (Arkansas); Barbara Mikulski (Maryland); Bill Nelson (Florida); Ben Nelson (Nebraska); Mark Pryor (Arkansas); Ken Salazar (Colorado); and possibly the biggest blow of all…Jim Webb (Virginia). Every last one of these jackals deserves to have this vote hung ‘round their necks like the proverbial Albatross. (Class II, up for reelection in 2008. Find your primary challengers now. Class III, up for reelection in 2010. Class I, up for reelection in 2012.)


I don’t put party over principle. I put principle first. Consistently. So I will be holding accounts open on this vote forever more. Sniveling, spineless, cowardly and pathetic democrats caved because the Toddler-in-Chief stamped his wittle foot and threw a temper tantrum and demanded a new double-naught spy kit for his toy box, or he would spoil their pwans.


C’mon! Didn’t you people raise kids? You don’t give a snot-nosed punk with a flair for the dramatic anything but a time out, unless it's a red ass!


All those miles I walked canvassing, all those hours I phone banked, all those posts I blogged…Hell, I did some of the opposition research that Claire’s campaign should have done, and gave her the information about Talent missing fully 2/3 of meetings of the Senate Armed Services Committee during his tenure on that panel, while America was involved in two shooting wars. I could have not bothered to do any of those things and let the feckless Talent keep his seat and it would not have mattered where my civil liberties are concerned. How utterly disappointing. I frankly can not express the depth of my antipathy for my Democratic Senator right now.


She has failed to back timelines for withdrawal from Iraq, and while she hems and haws, Missourians die - 65 to date, and over half of the Missouri casualties were leadership...NCO's and Officers. And still, no mission. WTF???


Now, she has voted to give this president and this inept and incompetent attorney general unbridled domestic spying powers?


FISA does not need to be amended to give this president and his minions more authority! If anything, these bastards need MORE oversight, not less! The mere notion that he should get his way on this is simply madness!


The Democrats yesterday should have stood up and said “Hell no!” They should have said “Due to the history of abuse by this administration, and the fact that sweeping new powers would be put in the hands of an incompetent and compromised attorney general, because the very Justice department has been politicized, Because FISA court judges have RESIGNED over abuses by this administration, we must take a firm stand and say NO MORE POWER to abuse the civil liberties of American citizens."


But that would have taken courage.


As for me, I will never vote for nor will I support in any way any politician that has betrayed the Constitution with that vote. (h/t Skippy)

For Dick Lugar, Party Trumps Principle

This is why I put a 24-hour-hold on reporting anything that comes close to looking encouraging if it comes from a party apparatchik Republican. They always backpedal and retract and spin and explain what they really meant to say – probably after a visit from Karl’s boyz, but that’s just speculation…

Yesterday evening, Think Progress posted the following:

In a major speech on the Senate floor, Lugar said that “victory” in Iraq as defined by President Bush is now “almost impossible.” The current course of the war “has lost contact with our vital national security interests in the Middle East and beyond,” he said.

Lugar warned that “persisting indefinitely” with Bush’s escalation strategy “will delay policy adjustments that have a better chance of protecting our vital interests over the long term.” He specifically rejected claims that withdrawing U.S. forces will increase instability. Downsizing the U.S. military presence in Iraq would “strengthen our position in the Middle East, and reduce the prospect of terrorism, regional war, and other calamities,” Lugar said.

And today, MSNBC tells us that I was smart to hold off on praising him, because he intends to take the sniveling cowards way out, and has no intention of backing up his bold rhetoric.

Lugar won't switch vote
However, [Lugar spokesman Andy] Fisher said the speech does not mean Lugar would switch his vote on the war or embrace Democratic measures setting a deadline for troop withdrawals.

In January, Lugar voted against a resolution opposing the troop buildup, contending that the nonbinding measure would have no practical effect. In spring, he voted against a Democratic bill that would have triggered troop withdrawals by Oct. 1 with the goal of completing the pull out in six months.

Next month, Senate Majority Leader Harry Reid, D-Nev., plans to force votes on several anti-war proposals as amendments to a 2008 defense policy bill. Members will decide whether to cut off money for combat, demand troop withdrawals start in four months, restrict the length of combat tours and rescind Congress' 2002 authorization of Iraqi invasion.

Expected to fall short of the 60 votes needed in the Senate to pass controversial legislation, the proposals are intended to increase pressure on Bush and play up to voters frustrated with the war.

Change ain’t gonna happen until this president is forced to deal with the reality that is “dealing with” ~30 Americans a week – and the only way he is going to be forced into facing facts is if members of his own party insist that he do so.

Dick Lugar should hang his head in shame. And he should also attend the funeral of every Indianan who falls and explain to the grieving family members why he puts party and politics above the lives of their loved ones.
